California case challenges teacher job protection laws

Yahoo! National News - Thu, 03/27/2014 - 19:02
Closing arguments were set to begin Thursday in a closely watched California legal case that could change the way public school teachers are hired and fired in the most populous U.S. state. "We're asking the court to declare that these five education codes are unconstitutional and that they violate the equal protection clause," said Marcellus A. McRae, one of several attorneys arguing the case before a judge in Superior Court in Los Angeles. "They place students into two groups - those getting effective teachers and those who are not getting effective teachers," he said. The group behind the lawsuit, Students Matter, was founded by Silicon Valley businessman David Welch and boasts the firepower of the Los Angeles law firm of Gibson, Dunn & Crutcher, which mounted a team of many of the same attorneys to successfully overturn California's anti-gay marriage initiative, Proposition 8.

Montana bride accused in husband's cliff death to be sentenced

Yahoo! National News - Thu, 03/27/2014 - 19:01

Jordan Graham leaves U.S. District court in Missoula, MontanaA Montana bride who shoved her husband of eight days off a cliff at Glacier National Park is due to be sentenced on Thursday, and a judge was expected to rule on a defense motion to withdraw her guilty plea to a second-degree murder charge. Attorneys for 22-year-old Jordan Graham on Tuesday asked a federal judge to rescind her guilty plea from December, alleging prosecutors are overreaching by seeking a life sentence and reneging on an agreement that they expected to involve less prison time. Federal prosecutors wrote in documents submitted on Wednesday that Graham's request to withdraw her plea was without merit and should be denied. In exchange for Graham pleading guilty to second-degree murder in the July 7 death of her husband of eight days, 25-year-old Cody Johnson, prosecutors dropped a first-degree murder charge, which alleges premeditation and carries a mandatory life sentence.

Texas set to execute man who killed food delivery woman with bat

Yahoo! National News - Thu, 03/27/2014 - 19:01
By Jon Herskovitz AUSTIN, Texas (Reuters) - Texas is set to put to death convicted murderer Anthony Doyle on Thursday as it keeps steady its pace of executions while other states have had to postpone capital punishments because they cannot obtain drugs used in lethal injections. He is scheduled to die by lethal injection at the state's death chamber in Huntsville at 6 p.m. CDT. Texas, which has executed more people than any other state since the U.S. Supreme Court reinstated the death penalty in 1976, has obtained a fresh batch of its execution drug pentobarbital, the Department of Criminal Justice said this month, without revealing the source. Many other U.S. states have been struggling to obtain drugs for executions after pharmaceutical firms, mostly in Europe, imposed sales bans because they object to having medications used in lethal injections.
